so what are the legalities of stunting in a certian area? is it possible to do so in a parking lot with the owners permission? besides trespassing, what is the issue in doing it?

its a soso type thing. People dont want to be responsible for personal injury, they dont want their property damaged.... but yet they like to watch. The only complaint we get down at the business park is noise and the cops dont want us racing... But I have had officers tell me that they would much rather have us there than on the highway ya know.... either way there are haters and supporters... and either way, im still gonna do what I do hahaha :rad:

Unless you can completely block off traffic from being able to enter the parking lot (gate, wall, caution tape, possibly even traffic cones), it is legally considered the same as a street. All traffic laws still apply, and charges are the same, or worse because of the reduced speed limits in parking lots.:2cents:

i ran a stop sign in walmart parking lot one day and a cop pulled me over after i pull off walmart property and tried giving me a ticket and i told him its privet property and he took the ticket back. the only way he could of gave me a ticket is if walmart would of called them.If it was a stop sign that Wallyworld installed, it might not have the same legal standing. But to tell you the truth, the cop might have not been sure enough about the legality of the ticket, and didn't want to get embarrassed in court.

Now if you would have been doing cookies in the parking lot, I can garanty you would have gotten a careless, if not a reckless, driving ticket.

If it is a premises open to the public, meaning it has direct unrestricted access from the road, same basic rules apply.

From what I heard from a cop buddy is that they can bust you for driving/riding a car/motorcycle on private property if you are on drugs/drunk or being reckless.

Parking lots are private property and cops do not have the same right to enforce laws as on public property. Someone once backed into the side of my car in a parking lot in Spfld., and refused to give me their information. I called the cops, and they said they couldn't do anything because it happened on private property. They told me I'd have to sue the driver.
In order for you to be trespassing, you would have to be ignoring posted signs or have been previously warned, I think. I don't think the cops could bother you on private property unless they got a complaint from the owner, or a noise complaint from a neighbor.
Personally, I wouldn't ask a property owner for permission, as the answer would almost certainly be no. Just find an empty lot where the business is closed and you won't bother the neighbors, and go for it. What about the old Romania Chev dealership on Franklin? That's all closed & boarded up, and you couldn't hurt the property much.

Best way to find out for sure is simply to call the Police Dept. and ask someone in the Patrol Division. :cop-car:

Regardless of wether the propty owner told you it was ok, unless they are there to stand as witness to it, the cops can shoo you off...

ummmm, things must have changed over the years,
I followed a person for several miles to a grocery store because of their erratic driving, When they got out and went into the store they obviously were off their meds or drunk.
I called the EPD and was told they couldn't do anything until they got back in the car and presented a problem on the street. Not the parking lot.

crap shoot I say.....

Any traffic crime (Reckless Driving, DUII, Hit and Run because it's a crime, etc.) can be enforced on a Prem. Open to the Public. Prem Open to the Public are parking lots and even a private driveway if not gated according to the 9th Circuit Court of Appeals.

There are also a few Major Traffic Violations that can be enforced on Prem. Open to the Public, including Careless Driving, Driving Uninsured. As far as the DUII that you called in, as long as you witnessed the person driving, the cop could have done the investigation based on Probable Cause, because DUII is a crime. However, there are so many ways for someone to fight the DUII that they are really hard to win, and you would have to be named as a witness and go to testify in court, you could not be an anon. reporter.

We have several streets and sub divisions as well as mobile home parks, and the managers always call and complain about speeders in the park, or running stop signs in the park. If it's a private street, the minor traffic infractions are not enforcable, hence we tell them speed bumps, and thats why most Mobile Parks have em....:yes:

i got thown in jail for duing a cookie in a cage on privet property, would not let me out till i payed 10% of the ticket :yell:

ya, eugene speedway is now a closed down neighbor to walmart...in lane county its hard to do anything motorsport related...um... noise and other complaints are made and it ruins it....

You can still see the remains of Eugene Speedway, not only as you drive by but from space. Use maps.google.com in satellite mode and find it. Fun fun fun! (Ok, not that fun but kinda fun.)
